Welcome to DropSwift. These Terms and Conditions ("Terms") govern your access to and use of the DropSwift platform, website, mobile applications, services, and related technologies operated by DropSwift ("Company," "we," "our," or "us"). By accessing or using our services, you agree to comply with and be legally bound by these Terms. If you do not agree to these Terms, you must not use the platform.

1. Introduction

DropSwift is a technology-based delivery and logistics platform operating within Ghana. Our platform connects customers who require delivery services with independent riders and delivery agents who fulfill those requests.

These Terms apply to:

• Customers using the platform to request deliveries
• Riders providing delivery services
• Businesses and merchants using the platform for logistics
• Visitors accessing our website or applications

By creating an account or using any part of the platform, you confirm that:

• You are at least 18 years old or using the platform under lawful supervision
• You have the legal capacity to enter into binding agreements
• All information provided is accurate and truthful

2. Definitions

For the purpose of these Terms:

• "Platform" refers to the DropSwift website, applications, APIs, dashboards, and related systems.
• "Customer" means any individual or business requesting delivery services.
• "Rider" means any independent delivery partner using the platform to complete deliveries.
• "Delivery" refers to transportation of goods, packages, or items from one location to another.
• "Merchant" refers to a business integrated with DropSwift for logistics operations.
• "Account" means a registered user profile created on the platform.

3. Acceptance of Terms

By accessing or using DropSwift, you acknowledge that you have read, understood, and agreed to these Terms and all related policies, including our Privacy Policy.

If you do not agree with any part of these Terms, you must discontinue use of the platform immediately.

4. Account Registration and Security

To access certain features of the platform, users may be required to create an account.

You agree to:

• Provide complete and accurate information
• Keep your login credentials confidential
• Update your information when necessary
• Accept responsibility for activities conducted under your account

You must not:

• Create fake or misleading accounts
• Share accounts with unauthorized persons
• Attempt to gain unauthorized access to the platform

DropSwift reserves the right to suspend or terminate accounts that violate these Terms.

5. Delivery Services

DropSwift provides a technology platform that facilitates delivery requests between customers and riders.

We do not directly transport goods unless explicitly stated. Riders may operate as independent contractors and are responsible for fulfilling deliveries professionally and lawfully.

Delivery estimates, tracking information, and arrival times are approximate and may vary due to:

• Traffic conditions
• Weather conditions
• Mechanical issues
• Road closures
• Security concerns
• Other unforeseen circumstances

DropSwift does not guarantee exact delivery times.

6. Customer Responsibilities

Customers agree to:

• Provide accurate pickup and drop-off information
• Ensure recipients are available when necessary
• Properly package items for safe transportation
• Avoid sending prohibited or illegal items
• Pay all applicable delivery fees and charges

Customers must not use the platform to transport:

• Illegal substances
• Weapons or explosives
• Hazardous materials
• Stolen goods
• Fraudulent or counterfeit products
• Items prohibited under Ghanaian law

Customers are solely responsible for the legality and ownership of items submitted for delivery.

7. Rider Responsibilities

Riders using the platform agree to:

• Maintain valid licenses and identification documents
• Operate vehicles safely and lawfully
• Deliver items responsibly and professionally
• Protect customer packages from damage or theft
• Maintain respectful communication with customers

Riders must comply with all traffic laws, transportation regulations, and safety requirements within Ghana.

DropSwift reserves the right to suspend riders who:

• Receive repeated complaints
• Engage in fraud or misconduct
• Violate safety policies
• Fail verification or KYC requirements

8. Payments and Billing

All payments made through DropSwift are processed using secure third-party payment providers, including Paystack and other approved processors.

Users agree that:

• Delivery fees may vary based on distance, urgency, traffic, and package type
• Additional charges may apply for waiting time, failed deliveries, or special handling
• Payments must be completed before or after delivery as specified on the platform

DropSwift reserves the right to:

• Modify pricing structures
• Introduce service fees
• Hold transactions for fraud review
• Refuse suspicious transactions

Failure to complete payment may result in account suspension.

9. Refund Policy

Refunds may be issued under limited circumstances, including:

• Failed deliveries caused by platform errors
• Duplicate charges
• Verified payment processing issues

Refund requests must be submitted within a reasonable timeframe after the transaction.

Refunds may not be granted for:

• Customer-provided incorrect addresses
• Recipient unavailability
• Delays caused by uncontrollable circumstances
• Minor timing differences

DropSwift retains discretion regarding refund approvals.

10. Prohibited Activities

Users must not:

• Use the platform for unlawful purposes
• Engage in harassment, abuse, or threats
• Interfere with platform operations
• Attempt hacking or unauthorized access
• Upload malware or malicious code
• Manipulate pricing or transactions
• Use automated bots without authorization
• Impersonate other individuals or businesses

Violations may result in immediate account termination and possible legal action.

11. Location Tracking and GPS Services

DropSwift may collect and process real-time location data for operational purposes, including:

• Rider tracking
• Delivery route optimization
• Live order monitoring
• Fraud prevention
• Safety verification

By using the platform, users consent to location tracking where necessary for service delivery. Location information is handled according to our Privacy Policy.

12. Intellectual Property

All platform content, including logos, designs, software, code, branding, text, graphics, and features, remain the exclusive property of DropSwift unless otherwise stated.

Users may not:

• Copy or redistribute platform materials
• Reverse engineer the software
• Reproduce branding without permission
• Create derivative works based on the platform

Unauthorized use may result in legal action.

13. Data Protection and Privacy

DropSwift values user privacy and implements reasonable security measures to protect personal information. By using the platform, you consent to the collection and use of data as described in our Privacy Policy.

While we implement security safeguards, no online platform can guarantee absolute security. Users are responsible for safeguarding their accounts and devices.

14. Third-Party Services

The platform may integrate with third-party services including payment processors, mapping providers, SMS gateways, email services, and cloud hosting providers.

DropSwift is not responsible for interruptions or failures caused by third-party providers. Use of third-party services may also be governed by their respective terms and policies.

15. Service Availability

We strive to maintain reliable platform availability but do not guarantee uninterrupted service. The platform may occasionally experience maintenance downtime, network interruptions, technical failures, or security incidents.

DropSwift reserves the right to modify, suspend, or discontinue services without prior notice.

16. Limitation of Liability

To the maximum extent permitted by law, DropSwift shall not be liable for:

• Indirect or consequential damages
• Loss of profits or business
• Delivery delays
• Data loss
• Unauthorized account access
• Damages arising from rider or customer conduct

Our total liability shall not exceed the amount paid for the affected transaction.

17. Indemnification

Users agree to indemnify and hold harmless DropSwift, its employees, affiliates, partners, and agents from claims, liabilities, damages, or expenses arising from:

• Violation of these Terms
• Misuse of the platform
• Illegal activities
• User-submitted content
• Breach of applicable laws

18. Account Suspension and Termination

DropSwift reserves the right to suspend or terminate accounts without prior notice for:

• Violations of these Terms
• Fraudulent activities
• Security risks
• Abuse of the platform
• Non-payment

Termination may result in loss of access to platform features and data.

19. Modifications to Terms

We may update these Terms periodically to reflect legal requirements, operational changes, new features, or security improvements. Updated Terms become effective upon publication on the platform.

Continued use of DropSwift after updates constitutes acceptance of the revised Terms.

20. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Ghana. Any disputes arising from the use of the platform shall be resolved under the jurisdiction of Ghanaian courts.

21. Force Majeure

DropSwift shall not be held liable for delays or failures caused by circumstances beyond reasonable control, including:

• Natural disasters
• Floods
• Fires
• Government restrictions
• Internet outages
• Civil unrest
• Strikes
• Epidemics

23. Entire Agreement
